We leased a condo at Lighthouse Village as a part-time residence, approximately 100 miles from our permanent home, to accommodate work schedules in the Pompano Beach area. We were present roughly three days per week.
In the approximately year and a half we were residents, the association cycled through three different property management companies. That level of turnover is, in our experience, unusual and worth noting.
From early in our tenancy, we encountered selective enforcement of community rules and standards that appeared to apply to some residents but not others, with no consistent or transparent basis for the distinction. When we raised concerns, we were told by a board member that we had no rights as renters. Despite a Cease and Desist letter from our attorney, additional false allegations of violations continued, none of which were supported by evidence. When we formally requested evidence, it was not provided to us or our landlord (who has since listed the property for sale).
After our attempts to seek resolution directly with the association board/property manager were dismissed, we retained legal counsel and prevailed. Months later, after four false allegations and fines from our landlord, we sought relief from the Court. We prevailed in mediation where the violations alleged against us were found to be without merit. The selective enforcement we experienced was substantiated, our fines were refunded, and legal fees were reimbursed.
Despite these outcomes, the experience of living under this board's conduct had become untenable enough that we made the difficult financial decision to break our lease and pay a significant early termination fee simply to leave. That is not a decision anyone makes lightly.
WHAT PROSPECTIVE RESIDENTS SHOULD KNOW
We encourage potential residents, here or elsewhere, to review court records and request the association's complete violation history and enforcement records, which Florida law gives the right to access. Ask how disputes are handled and what recourse residents have. Speak with current residents if you can. And factor into your decision not just the appeal of the property itself, but the governance structure you will be living under.
Our experience may not be universal. But it was real, it was documented, and it was costly.
